Klasik Dönem İhya Çabaları Bağlamında Endülüslü İbn Hazm ve Usûl Anlayışı

In this study, it is aimed to introduce İbn Hazm and his law procedure concept, which has systematized the religious order Zâhiriye and owns the literature carrying these ideas into today. A muctahid (law expounder of Islamic law) for hadiths, Ibn Hazm has different views from other muctahids on various points. In terms of methodology, he criticizes harshly the other muctehids. Nusūs (texts of verses and hadiths) and his literal interpretations constitute the fundamental of his methodology/usūl concept. Unless there is an explanation from Allah and His Prophet (pbuh) no one has the right to say anything on his/her own thoughts. Although some of his thoughts are open to discussion, he is a scholar who has valuable contributions during the development of the Islamic culture. He is one of the pioneers during the criticizing period based on nass (verse and hadith) in Islamic culture.

Bu makalede Endülüs’te Zâhiriye Mezhebini sistemleştiren ve bu mezhebin görüşlerini günümüze kadar taşıyan eserlerin müellifi olan İbn Hazm ve usul anlayışı tanıtılmaya çalışılmaktadır. Hadis taraftarı bir müctehid olan İbn Hazm, pek çok noktada diğer müctehidlerden farklı görüşlere sahiptir. Metodoloji açısından diğer müctehidleri acımasız eleştirmektedir. Usul anlayışının temelini nasslar (ayet ve hadis metinleri) ve onların lâfzî yorumları oluşturmaktadır. Bir konuda Allah'tan ve Hz. Peygamber’den bir açıklama gelmedikçe hiç kimsenin onlar adına kendi re’yi ile bir beyanda bulunma yetkisi yoktur. O, bazı görüşleri tenkide açık olmakla birlikte İslâm kültürünün oluşumunda değerli katkıları olan bir düşünürdür. İslâm kültüründe nassa bağlı yeni bir eleştiri döneminin öncülerinden biridir.
